The plain-English version: If you hire AIVibeSite to build your website, here's what you can expect from us, what we expect from you, and what happens if something goes wrong. By signing a project proposal, paying a deposit, or otherwise engaging our services, you agree to these terms.
"AIVibeSite," "we," "us," and "our" refer to AIVibeSite, a website design and development service based in Gilbert, Arizona, operating at aivibesite.com. "You," "your," and "client" refer to the individual or business engaging us for services. AIVibeSite operates as a sole proprietorship under the laws of the State of Arizona.
AIVibeSite provides custom website design and development services for businesses and individuals. Specific deliverables, timelines, and pricing are described in each individual project proposal you receive after submitting an inquiry. The proposal is the controlling document for your specific project; these terms apply to all projects generally, and where a proposal and these terms conflict, the proposal governs for that project.
Services may include website design, copywriting, logo design, brand identity work, custom illustration, custom theme song generation (via SheHarmony), domain setup, hosting setup, basic SEO, and ongoing maintenance under a Care Plan add-on.
A project begins when you submit an inquiry, receive and approve a written proposal, and pay the required deposit. No work begins until the deposit clears. Submitting an inquiry does not by itself create a binding agreement or reserve your spot in the queue.
Founding member rates apply to the first 20 clients across all tiers combined. Once those spots are filled, pricing returns to standard rates. We do not use fake countdown timers — when the founding spots are gone, prices simply go up. Your rate is locked at the price stated in your signed proposal.
Unless your proposal states otherwise, projects require a 50% deposit to begin and the remaining 50% before final delivery or launch. Payments are processed through Stripe. Care Plan subscriptions are billed monthly through Stripe and continue until cancelled. Prices are in U.S. dollars. You are responsible for any applicable taxes.
Estimated delivery times are stated per tier and in your proposal. Timelines assume you provide required materials (content, photos, logins, feedback) promptly. Delays in providing materials or feedback extend the timeline accordingly. We are not responsible for delays caused by third parties such as domain registrars, hosting providers, or payment processors.
Each tier includes a set number of revision rounds, described in your proposal. A "revision round" is one consolidated set of change requests. Additional rounds beyond those included are billed at our then-current hourly or flat rate, quoted before any extra work begins.
If you request work beyond what your proposal describes (additional pages, features, integrations, or creative direction), we'll provide a written estimate for the added scope before starting. Approved scope changes may adjust the price and timeline.
Upon full payment, you own the final delivered website files, custom copy, and custom logo created specifically for your project. We retain ownership of our underlying tools, methods, code frameworks, and any pre-existing materials, and we may reuse general techniques and know-how on other projects. We may display your completed project in our portfolio and marketing unless you request otherwise in writing.
You are responsible for ensuring any content, images, trademarks, or materials you provide to us are legally yours to use. You agree that your provided materials do not infringe anyone else's rights.
Brand and Signature projects include a custom theme song produced through SheHarmony. The song is generated using AI and provided as a bonus deliverable. Rights to the finished audio file transfer to you on full payment. SheHarmony's own terms apply to the generation process.
We can set up hosting (typically Netlify) and connect your domain, but you own and control your domain and hosting accounts. You are responsible for domain renewal fees and any hosting costs beyond free tiers. If you cancel a Care Plan, your site remains yours and hosted wherever you choose — nothing is held hostage.
Because work begins immediately after the deposit clears, deposits are non-refundable once work has started. If you cancel mid-project, you are responsible for payment covering work completed to that point. If we are unable to complete your project for reasons within our control, we will refund any amount paid for work not yet delivered. Care Plans can be cancelled anytime; cancellation stops future billing but does not refund the current month.
We build your site to work and look great at launch, but we are not responsible for: your business results or revenue; third-party service outages (hosting, domains, payment processors, email); changes you or others make to the site after handoff; content or materials you provide; or issues arising from you not maintaining the site. We provide no guarantee of specific search rankings, traffic, or sales.
We keep non-public information you share with us confidential and use it only to deliver your project. You agree to keep our non-public business information, pricing details, and processes confidential as well.
To the fullest extent permitted by Arizona law, our total liability for any claim arising from a project is limited to the amount you paid us for that project. We are not liable for indirect, incidental, or consequential damages, including lost profits or data.
Either party may end a project relationship with written notice. If you terminate, Section 12 (refunds) applies. We may terminate a project and refund undelivered work if a working relationship becomes unworkable — for example, abusive conduct or repeated failure to provide materials or payment.
These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. If we disagree about something, please email us first at hello@aivibesite.com and we'll try to resolve it directly. If we can't, any formal dispute will be handled in the state or federal courts located in Maricopa County, Arizona, and both parties consent to that venue. Both parties agree to attempt informal resolution before starting any legal proceeding.
We may update these terms occasionally. If you have an active project or Care Plan when terms change, the version in effect when you signed your proposal continues to apply to that project. Future projects use the current version.

Do I own my website when it's done?
Yes. Once you've paid in full, the finished site files, your custom copy, and your custom logo are yours. You can host them anywhere — nothing is locked to us.
Is my deposit refundable?
The deposit is non-refundable once work starts, because we begin building right away. If we cancel a project on our end before delivering, we refund anything paid for work not yet done.
What happens if I cancel my Care Plan?
Your site stays yours and stays online wherever it's hosted. Cancelling just stops future monthly billing — we never hold your site hostage.
Can you guarantee I'll rank #1 on Google or get more sales?
No — and be cautious of anyone who does. We build fast, SEO-sound, professional sites, but traffic and revenue depend on many factors outside a website alone.
Where would a legal dispute be handled?
Under Arizona law, in the courts of Maricopa County, Arizona. But we ask that you email us first — nearly everything gets resolved with a direct conversation.
